In Florida, a misdemeanor is a crime that is punishable by up to 1 year in jail. There are two levels: first-degree misdemeanors and second-degree misdemeanors.
Understanding the Differences
The main difference between the two degrees is how serious the crime is and how harsh the punishment can be:
First-Degree Misdemeanors
- First-degree misdemeanors have a maximum penalty of up to 1 year in jail.
- Common first degree misdemeanors include: Domestic Violence Battery, Battery, Criminal Mischief, Trespass, Violation of Protection Order, Driving Under the Influence, and Petit theft, to name a few.
Second-Degree Misdemeanors
- Second-degree misdemeanors have a maximum penalty of up to 60 days in jail.
- Common second degree misdemeanors include: Disorderly conduct, Reckless Driving, Refusal to Submit to Breath Testing, Driving With a Suspended License, No Valid Driver’s License, Possession of Drug Paraphrenalia
